It turns out that Nintendo messed up as they sent out discs that are corrupt to gamers around the US. This is interesting because it is the first time Nintendo has produced a game on a dual layered DVD. As with all new runs, it doesn't always work out the first time.

Gamers are now being asked to return the faulty disc free of charge and Nintendo will get them a new one. It turns out that you can't easily return the game to the store because they usually don't accept opened video games. This is quite an annoyance to Brawl fans, but at least Nintendo is doing the right thing.
